Slot booking system still works perfectly It shows available arrival slots on 17th and when you choose one and continue to departure, you get an error saying “The slot is no longer available” and suggestion to choose new arrival slot.

This is the new level of scam – charging landing fees even if you not landed at all. This could be easily challenged at court because (at the first glance) it’s against European customer protection law – you can’t be charged for non delivered/consumed goods or services.

Well, you can if the seller has had costs that associated with your reservation they can’t recover. (And that is made clear from the start.) In this case the airport can claim that because of the demand, a slot is a valuable commodity that they could have sold to someone else.

There are any number of very similar precedents, e.g. rail tickets or lodging that you can’t get refunded if you don’t show. Whether it is paid in advance or invoiced later doesn’t matter.

Landing fee definitely doesn’t fit to same category as lodging or tickets.

That should be covered by the ‘reservation fee’, not by the landing fee…

A no show of a train passenger doesn’t make any difference as regards cost, but if the train was fully booked refunding would mean a loss of revenue as the seat could very likely have been sold to someone else if the passenger has canceled. The same goes for landing fees where there are capacity restrictions. (You could argue if there really is a lack of capacity at EDNY of course…)

I’m not saying that charging a landing fee for a no-show is morally right. (It’s not.) I’m just saying that IMO you are likely to lose if you take it to court.

I think you picked wrong example. Landing fee is more comparable to highway toll. It’s use and pay service, not book and use. In addition, airport fees in EU (at least some countries if not all members) are regulated and approved by CAAs, so conditions for charging are predefined, I’m not sure that model defined here exists at any EU airport.

This is why the street robbers call it ‘processing and reservation fee’. Some even say Germany is bankrupt, on closing sale and they try to squeeze any little cent they can find out of the last customers.
