The first few I clicked seem to focus on businesses/LLCs, do they actually cater for private individuals?
Of concern should also be all the freelance FAA A&P/AI in Europe that also need to meet this regulation…… the impact could be a serious reduction in an already limited number of these who are active.
Part 145 repair stations will likely have a workaround or simply don’t fall under it if the maintenance authority belongs to the repair station and not the mechanics who do the work. In Europe, those employees likely only have EASA certificates. The other discussion about the maintenance oversight ruling being challenged by US groups (and on hold) would likely have more impact on 145 shops than this regulation.
Two whom I contacted were happy to be designated as agents for individuals. The Florida agent refrained from stating this explicitly. Instead, it stated individuals usually put their personal names in place of a business name on the website sign-up form, giving the impression consumer protection laws might not apply. Another matter to determine is whether these agents carry adequate E&O insurance, especially when subcontracting the service, as many US insurers walk the other way when the FAA is mentioned. The ToS for the Florida agent states: “We may work with third-party providers to provide some of the registered agent services. You acknowledge and agree that these service providers may assist us in providing you with registered agent services.”
Stevens & Legal in Hillsboro OR acts as an agent only for businesses.
I’ve been in correspondence with AOPA US about this new AC requirement and received an encouraging positive response:
This is something that AOPA is aware of and we’re reviewing whether or not this is something that we can provided as a service.
We hope to have a determination in a couple of weeks.
I’ll report back if/when I hear more.
